Definitions

  • Cooling-off Period: The period during which the consumer can exercise the right of withdrawal.
  • Consumer: A natural person who enters into a distance contract with the entrepreneur and does not act in a professional capacity.
  • Day: Calendar day.
  • Continuous Transaction: A distance contract related to a series of products/services delivered over time.
  • Durable Medium: Any means that allows the consumer to store information in a way that is accessible for future reference.
  • Right of Withdrawal: The consumer's ability to cancel the distance contract within the cooling-off period.
  • Entrepreneur: The natural or legal person who offers products/services remotely.
  • Distance Contract: A contract concluded through a system organized for distance sales using distance communication techniques.
  • Distance Communication Technique: Means of concluding a contract without the consumer and entrepreneur meeting in person.

Article 3 – Applicability

These terms apply to every offer and distance contract between the entrepreneur and the consumer. The text will be made available before the contract is concluded. If electronic, it will be provided in a way that allows storage on a durable medium.

Article 4 – The Offer

Offers are non-binding and may be subject to conditions. The entrepreneur will provide a detailed description of the products/services, including:

  • Price, including taxes
  • Shipping costs
  • Contract conclusion details
  • Right of withdrawal information
  • Payment and delivery methods
  • Period for accepting the offer

Article 5 – The Contract

The contract is concluded when the consumer accepts the offer. The entrepreneur will confirm the acceptance electronically. The consumer can dissolve the contract until acceptance is confirmed. The entrepreneur will provide necessary information with the product, including contact details for complaints and conditions for the right of withdrawal.

Article 6 – Right of Withdrawal

Consumers can cancel the agreement without reason within 14 days after receiving the product. To exercise this right, they must notify the entrepreneur within this period and return the product, ideally in original condition and packaging.

Article 7 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, return shipping costs are borne by the consumer. Refunds will be processed within 14 days after withdrawal, provided the product is returned or proof of return is provided.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products:

  • Made to consumer specifications
  • Clearly personal in nature
  • Which cannot be returned due to their nature
  • That spoil or age quickly
  • Whose price fluctuates in financial markets
  • For opened audio/video recordings and software
  • For hygienic products with broken seals

For services, exclusion may apply to accommodation or events, provided this is stated before the contract conclusion.
